Evaluatie bewijst: bewaarplicht telecomdata moet verdwijnen

Er moet een eind komen aan de verplichting voor telecombedrijven om gegevens over het bel- en internetgedrag van hun klanten te bewaren, stelt GroenLinks-europarlementariër Judith Sargentini. Met grote vertraging is vandaag de evaluatie van de Europese bewaarplicht verschenen. De Europese Commissie is er niet in geslaagd de noodzaak van deze inbreuk op de privacy aan te tonen. Er zijn slimmere manieren om boeven en terroristen te vangen.

De richtlijn over de bewaarplicht uit 2006 is, in de woorden van de Europese toezichthouder gegevensbescherming Peter Hustinx, 'de meest privacy-schendende maatregel die de Europese Unie ooit heeft aangenomen´. Waar en met wie je belt, wanneer je online bent en met wie je mailt: het moet allemaal langdurig worden opgeslagen door telefoon- en internetproviders. Politie of inlichtingendiensten kunnen deze gegevens vervolgens opvragen. "Zo worden alle burgers op voorhand als verdachten behandeld. Daar moet een eind aan komen," aldus Sargentini.

"De statistieken die de Europese Commissie vandaag heeft gepresenteerd verantwoorden de inbreuk op de grondrechten van privacy en gegevensbescherming niet", constateert Sargentini. "De meeste telecomgegevens die worden gebruikt voor de opsporing en berechting van strafbare feiten waren ook beschikbaar geweest zonder de bewaarplicht. Deze heeft dan ook niet geleid tot minder misdaad of tot een hoger oplossingspercentage."

“Nu de noodzaak van de bewaarplicht niet overtuigend kan worden aangetoond, is deze in strijd met het grondrechtenhandvest van de Europese Unie. Er zijn alternatieven voor de massale en peperdure opslag van ieders bel- en internetgegevens. Zoals quick freeze: als justitie een concrete verdenking heeft tegen iemand, kan zij telecomproviders opdracht geven om de bel- en internetgegevens van die persoon te bewaren.”

'Data retention is here to stay', verklaarde de verantwoordelijk eurocommissaris, Cecilia Malmström, eind 2010, nog voor de evaluatie was afgerond. Dat was veel te voorbarig, vindt Sargentini. "Als Malmström haar eigen evaluatie serieus neemt moet zij voorstellen om de bewaarplicht af te schaffen. Als zij – zoals ze aankondigt – alleen met een wetsvoorstel komt om te sleutelen aan de bewaarplicht, is het Europees Parlement aan zet: dat kan de wijzigingsprocedure aangrijpen om de bewaarplicht alsnog te torpederen."

New evaluation underlines need to scrap data retention directive

The European Commission today published an evaluation report on the EU directive on data retention for telecommunications data. The Greens believe the report, which has revealed the far-reaching nature of data retention under the rules, underlines the need to annul the directive. Commenting on the report, Green home affairs expert Jan Philipp Albrecht said:

"This evaluation makes clear that the EU data retention directive is completely disproportionate, allowing for the far-reaching retention of telecommunications data with no real justification. Under the directive, EU member states and telecommunications authorities can store masses of data based on unclear and ill-defined criteria, with no requirement to prove the retention is necessary for combating terrorism or organised crime. This far-reaching and groundless data retention is a clear infringement of the basic rights of EU citizens. The only proportionate response to these damning findings is to scrap the directive and we call on the Commission to take immediate steps to this end.

"The data retention directive was and remains an excessive knee-jerk response to terrorist attacks in Europe. There is no evidence that the far-reaching retention of data has led to any concrete results beyond compromising civil liberties. Following on from clear rulings by constitutional courts in Germany, Romania and the Czech Republic, it is now high time that the directive is revoked."
