Bouwovertredingen aan de Spaanse Costa's aangeklaagd

Vandaag keurde de Commissie Verzoekschriften een rapport goed dat er kwam nadat 15.000 handtekeningen werden verzameld. De ondertekenaars van de petitie klagen de nefaste effecten aan van de uitgebreide verstedelijking in Spanje op de individuele rechten, het milieu en de toepassing van EU-wetgeving.

De verzoekschriftenprocedure geeft EU burgers de mogelijkheid om langs buitengerechtelijke weg verhaal te halen bij klachten over het EU-beleid.

Corrupte lokale ambtenaren knijpen in Spanje geregeld een oogje toe als het aankomt op het verlenen van bouwvergunningen in de kuststreken. Deze ongebreidelde bebouwing heeft al veel schade toegebracht aan de biodiversiteit, het milieu en de eigendomsrechten van individuen. Veelal wordt de bestemming van landbouwgrond gewijzigd in bouwgrond, waardoor vooral makelaars en projectontwikkelaars grote sommen verdienen. Het gaat ook vaak over beschermde gebieden vanwege hun kwetsbare flora en fauna.

Duizenden Europese burgers voelen zich bedrogen omdat zij als gevolg van de plannen van de makelaars niet alleen hun legitiem verworven eigendom hebben verloren, maar ook gedwongen werden willekeurig vastgestelde kosten te betalen voor ongevraagde, veelal onnodige en ongegronde infrastructuurprojecten. Voor vele gezinnen is dit op een financiële en emotionele ramp uitgelopen.

Het rapport roept de Spaanse autoriteiten op om hun wetgeving grondig te herzien en goed functionerende justitiële en bestuurlijke mechanismen in te voeren die worden gemachtigd om in schadeloosstelling en compensatie te voorzien.

Als Spanje nalaat hieraan gevolg te geven, vraagt het rapport dat de Europese middelen uit de Structuurfondsen worden geschorst.

Het rapport wordt normaalgezien op 26 maart 2009 gestemd in het Europese Parlement in Straatsburg.

Parliament committee backs petitioner calls for Spanish action on illegal urbanisation

Urbanisation abuses in Spain, particularly in coastal regions, have caused environmental degradation and property owners losing rights to their own land. Today, in the face of opposition from certain MEPs from the Spanish PP and PSOE parties, a report by Danish Green MEP Margrete Auken was approved by the European Parliament petitions committee (1).It criticises inaction by the Spanish authorities and the misuse of EU funding, which could be withdrawn if the situation is not addressed. She commented:

"I am very pleased that we have sent a clear message to the Spanish government to put an end to long-standing abuses of property rights and the environmenton their coastline. Over 15,000 petitioners and nearly 1 million empty properties point to a chronic problem of profiteering before people and unsustainable development. We will not give up until this unacceptable situation is finally addressed.

The failure of the Spanish legal system and the contravention of numerous EU directives have made this a European issue. Petitioners turned to the European Parliament for help because the Spanish authorities have too often ignored or failed them. European laws relating to water, the environment and public procurement have been systematically violated.

Today's vote is therefore a victory for the respect of individual landowners and for environmental protection everywhere in Europe, not only in Spain. It sends a clear message that authorities must respect people as players and not just payers."

Spanish Green MEP David Hammerstein commented:

"The vote in the European Parliament today is a victory for the Spanish petitioners and for citizens across Europe concerned with excessive and illegal urbanisation on the Spanish coastline. Spain represents a unique case in Europe and deserved the European Parliament's attention. Petitioners and the European Parliament petitions committee must now be heard: Spain must take action to ensure urban development respects property rights and European Directives.

Attempts by Spanish PP and PSOE MEPs to water down the report backfired, as they only opened the way for other amendments that were even more clear in their criticism of the Spanish authorities."
