(29/11/06) Kaderrichtlijn diensten algemeen belang

Onlangs is de dienstenrichtlijn goedgekeurd waarbij diensten als sociale huisvesting, kinderzorg en ondersteuning van gezinnen of personen in permanente of tijdelijke nood, die worden verleend door de overheid buiten de richtlijn vallen. Ook diensten van algemeen belang vallen er buiten, al bestaat hier nog heel wat discussie over. Wat zijn precies diensten van algemeen belang en wie moet dat bepalen?

Een kaderrichtlijn zou een oplossing kunnen bieden. Principes zoals staatssteun, vrije dienstverlening en openbare aanbestedingen zouden zo kunnen geregeld worden. De kaderrichtlijn kan voor meer rechtszekerheid zorgen en de specifieke kenmerken van sociale diensten erkennen. Veel diensten van algemeen belang worden immers als economische diensten beschouwd, ook al zijn ze 'not-for-profit' en functioneren ze niet volgens het vrije marktprincipe.

Greens throw weight behind petition for a framework directive on public services

The Greens/EFA group has given its unconditional support to a petition calling for a framework directive on services of general interest, which was launched yesterday by the European Trades Unions Confederation (ETUC). Speaking at the launch of the petition, Greens/EFA Vice-President Pierre Jonckheer said:
"The Greens have been calling for a framework directive on services of general interest for a long time and welcome this initiative from ETUC, which will hopefully add to the momentum. Only by clearly setting out the goals and purposes of public services will it be possible to protect them from being undermined by competition law or internal market rules."

"In the absence of a framework directive, we are now in the regrettable situation where the Services Directive will serve as the horizontal instrument for the defining the nature of services of general economic interest in the EU. The Greens would like to reiterate their call for a thorough evaluation of the current liberalisation of the services sector and for the Commission to propose a legislative text outlining how to protect and promote services of general interest."
