(26/10/06) Vrije markt en sociale bescherming meer in evenwicht

De uitzendrichtlijn regelt de minimumnormen op het gebied van arbeidsvoorwaarden en -omstandigheden voor de verschillende manieren waarop werknemers in loondienst in het kader van een dienstverrichting tijdelijk in een andere EU-lidstaat zijn tewerkgesteld. Het is tevens het ontvangende land dat er volledig verantwoordelijk voor is dat aan de 'gedetacheerde' werknemers de op hen van toepassing zijnde bescherming en rechten worden gegarandeerd. Het is verplicht om maatregelen te nemen opdat de minimumnormen niet worden omzeild en het op die manier tot sociale dumping en oneerlijke concurrentie komt. Ondanks het feit dat dit een belangrijke míjlpaal is in de Europese arbeidswetgeving, zijn er aanzienlijke tekorten bij de tenuitvoerlegging van en de controle op de richtlijn.

Met het rapport van het groene EP-lid Schroedter reageert het EP op een communicatie van de Commissie, (reeds in 2004 beloofd, maar pas in april 2006 verschenen), waarin de Commissie de controlemaatregelen waarover de lidstaten beschikken tracht te beperken. Het rapport Schroedter hertekent het evenwicht tussen economische vrijmaking en sociale bescherming. Zo kunnen bepaalde administratieve maatregelen (bijvoorbeeld sociale inspectie inzake schijnzelfstandigheid, collectieve arbeidsovereenkomsten) niet langer gezien worden als beperking van het vrij verkeer van werknemers op de arbeidsmarkten van de Europese Unie, zoals ook het Hof van Justitie oordeelt.

De voorwaarden voor minimumbezoldigingen, arbeidsvoorwaarden en gezondheid en veiligheid op het werk en het principe van het ontvangende land, zijn belangrijke instrumenten in het voorkomen van sociale dumping en oneerlijke concurrentie. Ze zorgen tevens voor een eerlijke behandeling van werknemers en dienstverleners. De neoliberale koers die Europa reeds jaren volgt, krijgt met dit rapport een socialere wending. Het Europees Parlement neemt eindelijk zijn verantwoordelijkheid mbt. sociale bescherming van de werkenden.

EP report rejects attempts to relax rules combating social dumping

Following the adoption of the report on the application of the Posting of Workers Directive by a large majority in the European Parliament today (1) , German Green MEP and rapporteur Elisabeth Schroedter said:

"The Posting of Workers Directive is a crucial tool for combating social dumping in the EU and Member States must take their responsibilities seriously in implementing the directive to prevent posted workers from falling through the gap and being exploited. Firms operating cross-border should not be allowed to gain a competitive advantage by flouting employment rules in an attempt to cut costs at the expense of their employees.

"The report adopted by the Parliament today makes clear that any shortcomings are not the fault of the directive but rather poor implementation of its provisions. Against this background, it is unacceptable that the Commission is still trying to limit the controls, which Member States are obliged to carry out on companies posting workers in their jurisdiction, as part of the Services Directive (2).

"Guaranteeing basic employment standards in no way inhibits the free movement of services. This report sends a strong signal to the Commission not to go beyond its competences in interpreting decisions of the European Court of Justice on the posting of workers."

(1) The Schroedter report on application of the Posting of Workers Directive was adopted in the Parliament by 295 votes, with 72 votes against and 6 abstentions.

(2) Following the deletion of articles 24 and 25 from the Services Directive by the Parliament in its first reading, the Commission tried to reintroduce elements of those articles reducing obligations on Member States to control the posting of workers through an annex entitled 'Guidance on the Posting of Workers".
