(17/07/07) Polen weer op ramkoers met EU: start werken Via Baltica

Polen heeft vandaag te kennen gegeven dat het zal starten met de werken voor de zgn. Via Baltica. Deze weg loopt door een waardevol natuurgebied, beschermd door de habitatrichtlijn. Het lijdt geen twijfel dat Polen hiermee in overtreding is. Het lijdt al even weinig twijfel dat het land dat ook wéét.

Het Spaanse groene EP-lid David Hammerstein heeft in de EP-commissie Verzoekschriften gevraagd dat deze een brief zou schrijven naar de Europese Commissie. Die moet dan op haar beurt aan het Europees Hof van Justitie vragen werk te maken van het dossier en eventueel tijdelijke wettelijke maatregelen te nemen. Hoewel de Poolse voorzitter van deze commissie (Marcin Libicki) zich weerde als een duivel in een wijwatervat hebben de leden van de commissie ingestemd met dit verzoek.

Greens call for urgent measure by Court of Justice against Polish government in environmental dispute

Polish authorities have announced today the commencement of work on the "Via Baltica", a section of the trans-European network, on the first of August. With this action Poland is challenging European legislation, as the European Court of Justice is currently studying the case and could soon reach a judgement on an alleged infringement of European Environmental Law.

To ensure that a unique area of Europe, protected by Community law, is not destroyed by this road, Green MEP David Hammerstein requested the European Parliament's Committee on Petitions to write a letter to the European Commission asking it to urge the Court of Justice of the European Communities to take "urgent interim legal measures". This proposal has been accepted, notwithstanding the surprising and insistent rejections by the President of the Committee on Petitions, the Polish conservative Marcin Libicki.

David Hammerstein stated "The Polish government stepped up its fight against the European Institutions by now directly attacking the application of the Habitat Directive. It is a clear act of disloyalty with the EU Treaty, and opens yet another source of conflict with the European Union. The answer of the European Commission and the European Court of Justice must be straightforward and firm. Otherwise, European environmental legislation might soon lose all its backbone."
